This document defines the general conditions (“General Conditions”) governing the use of the sites www.sanraffaele.it and www.cupsr.it (hereinafter “Site” or “Sites”). The Service is provided by San Raffaele S.p.a. with registered office Via di Val Cannuta, 247 – ZIP code 00166 – Rome (RM), the Data Controller (hereinafter: “Data Controller”).

The services offered by the Holder are intended for people 18 years of age and older. Should the Controller become aware of the processing of data of minors under 18 years of age, it reserves the right to unilaterally discontinue the use of the service offered as well as to delete the data acquired.

Use of the Service implies full acceptance, without reservation, of these general terms and conditions. The General Conditions will remain valid and effective until amended and/or supplemented by the Owner. These will become effective on the date they are posted on www.sanraffaele.it and www.cupsr.it. The latest updated version of the General Terms and Conditions is the one that can be found in the above section of the Site and below.

1) Preliminary Directions.
The equipment (tablets, computers, applications, other means of telecommunications, etc.) that enables access, as well as the telecommunications expenses necessary to use this service, are the sole responsibility of the User.
The Owner expressly informs the User that if an upgrade of the Services requires changes in the User’s software or instrumentation, these shall be made in full at the User’s expense.
The Owner will inform Users in advance, unless technically impossible, of changes to the Services, including new or additional features that enrich the Services.

2) Service Features.
The Site is intended to publish information pertaining to the services provided by San Raffaele Spa. In addition, the Site, owned by San Raffaele Spa, provides Users with the ability to:

• Take advantage of an online booking service for specialist visits provided directly by St. Raphael Health Facilities;
• send your Curriculum Vitae to apply for a current or future open job position;
• Subscribe to a newsletter service.

3) Responsibilities of the Owner
The Holder is committed to maintaining the efficiency of the Service offered. Should it be forced to interrupt the Service due to exceptional events or maintenance, it will try to keep the periods of interruption and/or malfunction as short as possible.

4) Limitation of Liability
In no event shall the Owner be held liable for malfunctioning of the Service resulting from failures, overloads, and interruptions, even temporary, by telephone or energy supplies.

5) Intellectual Property Rights of the Services
The service and the trademarks, logos, graphics, photographs, animations, videos, text, and any other content are the intellectual property of the Owner or any parties named therein and may not be reproduced, used, or represented without the express permission of the rights holders.

6) Communications and Customer Service
All communications may be made at the above registered office or by writing to the email address: privacy@sanraffaele.it.

7) Jurisdiction and competent court
This contract is subject to Italian law. The language of this contract is Italian.
In case of a dispute, the place of jurisdiction is Rome.

8) Protection of Personal Data
Personal data provided by Users are protected in accordance with the provisions of EU Regulation 679/2016 and its subsequent amendments and supplements. The Owner discloses how it protects the privacy of users who consult the site in the Privacy Policy published and available at www.sanraffaele.it and www.cupsr.it

While browsing the site, information about the visitor may be acquired in the following ways:

(a) Data provided by the User

These are the cases in which it is the User himself who releases his personal data, after reading detailed privacy policy and giving consent to processing, in order to access certain services or to submit requests by e-mail. In this case, the sender’s address and/or any other personal data is acquired, which will be processed exclusively for the purpose of responding to the requests made or for the provision of the requested service.

(b) Browsing data

The website collects technical information about the hardware and software used by visitors, independently through the use of tools for analyzing connection files. Such information concerns:

• IP address
• browser type
• internet service provider
• operating system
• Domain name and addresses of Web sites from which he accessed or exited (referring/exit pages)
• Information about pages visited by users within the site
• access hours
• stay on single page
• internal path analysis (clickstream)
• video resolution
• type of connection
• country from which the user is connecting
• Presence of installed java plugins.

This information does not provide personal data about the visitor, but only technical/informational data that are collected and used in an aggregate and anonymous manner for the sole purpose of improving the quality of service and providing statistics concerning the use of the site. These data are deleted immediately after processing.

(c) Cookies

Cookies are portions of information that can be stored on a computer while browsing a website in order to process and identify usage data. The cookie file is usually very small in size and does not contribute to the saturation of physical hard disk space. The cookie is transferred to the visitor’s disk for record-keeping purposes to “store” which areas of a Web site have been visited. This choice saves time, allowing the visitor to reach the main parts of a site previously visited more quickly. There are different types of cookies:

Please also note that at the end of each browsing session, the user can in any case delete both the browsing cache-memory and the collected cookies from their hard drive.

9) Disclaimers and Warranties
By accessing the site and its services, you agree to:

• Do not use the site or the material on it to pursue illegal purposes;

• Harm the effectiveness or functionality of the site in any way;
• The Owner is not responsible for the conduct of users while browsing the site. It also assumes no responsibility with regard to the transmission on the user’s computer of any viruses and otherwise harmful content originating from third parties.

You expressly acknowledge and agree that:

a. the site and any ancillary services are provided “as is” and “as available.”

b. there is no guarantee (i) that the site and any ancillary services will meet the user’s needs, (ii) that the site and services will be provided without interruption, on time, securely, or error-free, (iii) that the results obtained from the use of the site and services are true and reliable (iv) that the quality of the information or other materials acquired or obtained can meet the needs of visitors, nor that (v) any errors in the published material are corrected.

10) Miscellaneous
These terms of access are to be applied and interpreted in accordance with the general rules established at www.sanraffaele.it and www.cupsr.it.

The user declares that he/she undertakes to report to the Owner any violation inherent in these terms of access as soon as he/she becomes aware of it. In particular, in the event of legal action concerning copyright infringement in relation to materials published by the site or related services, the user is encouraged to report any information in his or her possession via the e-mail address privacy@sanraffaele.it.

The information offered on this site cannot, under any circumstances, substitute for a consultation, examination, or diagnosis given by a physician.
